  Show Contract

An Agreement made this day ____________________________________________________, in Barrington, NH, between Carl and
Pamela Gammans d/b/a Redoak Kennels, hereinafter known as the breeder/seller, and
_______________________________________________, hereinafter known as the buyer. Whereby title to a male/female Saint Bernard
puppy, whelping date of ___________________ sired by _______________________________ and out of (the dam)
_________________________________________ is granted. Breeder/seller will transfer new ownership of said dog to buyer, and will
deliver to the buyer the duly completed AKC registration certificate on this dog, as well as a record of its medical history from birth to
date.

It is agreed between both/all parties that:

A) The breeder guarantees the puppy to be in good health to the best of the breeder’s knowledge at the time of sale. The breeder makes
no warranties as to the future condition or potential of the dog.
B) The buyer has ten (10) working days to take the dog to his/her veterinarian for a well check. If the veterinarian finds the puppy to be
in poor health or not sound, and certifies the findings with a certificate, the buyer may return said dog to the breeder for a full refund or
exchange of equal valued dog.
C) Should, within the first twelve months of the dog’s life, a serious congenital defect be detected and is confirmed by our veterinarian,
the breeder will replace the dog from the next scheduled breeding of the breeder choice.
D) Should, for any reason, the buyer no longer be able to take care of the dog, then the buyer agrees to contact the breeder and return
said dog to them (the breeder).
E) Under no circumstance is this dog to be kept outside on a runner or chain. Nor shall this dog be allowed to live outside without a
proper kennel appropriate in size for the needs of this breed.
F) Buyer agrees not to give up or transfer ownership to any organization that will use the dog for any type of laboratory or non
laboratory experiments.
G) Under no circumstances shall this dog be trained as an attack or fighting dog whether for sport, home, or property protection.
H) The dog is sold to the buyer as a show potential dog. The dog must be shown in sponsered AKC and or UKC events.
I) The buyer agrees to pay for all expenses related to showing of the dog or bitch
J) Carl J. Gammans shall remain co-owner of the dog or bitch.
K) The dog or bitch registered name will read;   Redoak’s ( insert name) .
L) All breeding either studding or whelping must be agreed to by co-owner.
M) Under no circumstance is the dog or bitch to be breed to a non AKC or UKC registered dog or bitch.
N) If a dog is purchased and said dog is hired for stud service then the first two stud fees are to be split with co-owner. Stud fees are
set at $1,200.00
1) Dogs may provide stud service after the age of two.
O) The Breeder shall have full breeding rights to the dog or bitch at no expense other than that of transportation or other related expense
to breeding.
P) If a bitch is purchased the breeder will get two puppies from the breeding or equlivant money. The breeder retains the right of 2nd
pick of first litter and first pick from second litter at no expense.
1) The bitch must be two years of age before breeding.
Q) The dog is given full registration rights under its AKC registration number.
R) Should the dog not conform to AKC confirmation standards, then the co-owner will sign off and the dog must be spayed or neutered.
S) Puppies must attend a basic obedience class within the first twelve months of their life.
T) These condition are set forth for the dog’s protection, as well as the Saint Bernard breed and for the protection of both   parties to
this contract.
U) The buyer agrees to feed only the best quality foods in order to maintain good health and soundness. The buyer also agrees to provide
the appropriate exercise that this dog needs.
V) Jurisdiction: It is agreed by the parties that the jurisdiction for this contract shall be the State of New Hampshire. All lawsuits shall
be filed in the Circuit Court for the County of Strafford, State of New Hampshire.
W) Attorney Fees: No attorney fee shall be awarded to either party under this contract.
X) Veterinary Fees or Medical Cost: Seller shall not be responsible for any veterinary fees or medical cost incurred by buyer.
Y) Liquidated Damages: Since the value of an animal is difficult to ascertain as it is subject to wide swings due to the subjective
nature of the individual dog. It is agreed by the parties of this contract that the amount of damages for breach of contract shall be
liquidated damages in the amount of the purchase price.

Should any one, or any combination, of these terms be broken, then the breeder has full right to repossess said dog from the buyer.
Repositions can occur at any time should any one of the afore mentioned terms be broken, and may be carried out with, or without,
notice.
